Questions Proposed and Approved By The Knox County Charter Review Committee

Question 4: Shall Section 3.08(D) of the Knox County Charter, regarding the duties of the Knox County Law Director, be amended by adding the following sentence to the end of the Paragraph:

Provided, however, that the Law Director shall have authority, within the budget approved by the County Commission for this purpose, to hire outside counsel when, in the judgment of the Law Director, such is necessary for the fulfillment of his/her duties under the Section.”

Sounds like either a) the Law Director will be able to hire his good ol' buddies
or b) the Law Director will be able to do a better job by having the ability to hire help

I can't tell if this is a legal loop hole or a good thing.

Law director: There are two amendments affecting the Knox County law director, and they attempt to resolve thorny problems. We think they should go back to the drawing board.

One proposal would give the law director authority to hire outside counsel if, in his judgment, it is necessary to fulfill his duties.

Obviously, if there is a conflict between one government agency or individual and another, the law director and his staff could not be expected to represent both. However, in such a conflict, it might be best for all concerned if County Commission appoints outside counsel from a pool of lawyers available for that purpose.
