Clarifying the convulted language on the Knox State Primary and County General Ballot for the election of August 5, 2004.
As I sat down to consider who I would vote for in early voting I realized my research was thorough enough and that some of the issues on the ballot were phrased such that I had the strong urge to refer to legal aid to understand them. It occurs to me most people (probably none) would go to a lawyer to clarify the issues so I thought we should have a forum here to discuss and clarify the issues.
I will post each item of the sample ballot as its own day. As I uncover information I will post additional information under it respective day. Understandably, the election is in 4 days so I doubt much activity here from myself or others. In future elections I will post the information well in advance.
The purpose of this forum is to create a more educated voter. Please avoid using this as an realm for slander and flamewars. Everyone is invited to comment under the respective candidate, question or section of the ballot and encouraged to put information here that will help people make better decisions on August 5. Question 1: Shall the Knox County Charter be amended by striking the term “Executive” wherever it may appear in the Charter and refers to the chief executive officer of Knox County, and substituting the term “Mayor?”

Question 2: Shall Section 5.01(E) of the Knox County Charter, regarding a one-year residency requirement for eligibility for election to the Knox County Board of Education, be amended to remove this requirement by inserting a period (“.”) after the word “petition” in the first sentence of the Paragraph and str iking the remainder of the sentence?

The Knox County Law Director shall be subject to the term limits provisions of this Charter to the s ame extent as any Constitutional officer of Knox County Government, as that term is defined by Article V II, Section 1 of the Tennessee Constitution.

Question 7: Shall Section 3.03 of the Knox County Charter, regarding the duties of the County Executive (Mayor) be amended by adding the following Paragraph:
(O) Develop purchasing regulations for all purchases made with funds that have been collected for the use of Knox County. Any such purchasing regulations shall be enacted as an Ordinance by the Knox County Commission. To the maximum extent allowed by law, each constitutional, statutory or Charter official of Knox County, whether appointed or elected, shall be required to follow the provisions of the Knox County Purchasing Ordinance for construction or purchases of goods and services with public funds.

An Ordinance providing that the City of Knoxville shall not authorize, appropriate, allocate, budget or provide for any public funds to be used to construct, cause to be constructed, or pay for or acquire (by exchange or otherwise) any new structures, facilities or land, including buildings or garage or park ing facilities or pedestrian connections or bridges, or related facilities and improvements, to be used primarily to support or assist a new convention center hotel in the City of Knoxville, including any funds pro posed (or to be proposed) in the City of Knoxville’s Capital Improvements Program and that the City of Knoxvil le shall not extend or use the credit or financial resources of the City of Knoxville to guarantee, support o r fund, directly or indirectly, any bonds, loans, or other debt obligations or other credit enhancement faci lities of any nature, to support or finance the construction or acquisition of any such above-described new facilities or structures, provided that this prohibition shall not apply to the City’s existing auth ority to otherwise provide for tax or lease abatements.
